If registration of birth or death is not done on time, then from October 1, 2026, the process will become more strict than before. Under the new provisions, the longer the delay in registration, the more an order from a higher level officer or judicial magistrate will be required. The government aims to strengthen investigation and monitoring of delayed birth and death certificates.
The most important change in the new rules has been made regarding registration of cases of birth or death older than two years. If there is a delay of more than two years in the registration of birth or death, now registration can be done only after the order of the Judicial Magistrate First Class in the concerned case.
DM or SDM's order necessary after delay of one to two years
If there is a delay in registration of birth or death by more than one year but up to two years, then an order of the District Magistrate (DM), Sub-Divisional Magistrate (SDM) or Executive Magistrate authorized on behalf of the DM will be required for registration. In this process, the relevant records will be verified and the prescribed fee will also be charged. Special emphasis in the new provisions is on those cases in which records of birth or death were not registered for a long time.
Arrangements have been made for scrutiny and approval from different levels of officials depending on the period of delay. The provision for these changes has been made in the Registration of Births and Deaths (Amendment) Bill, 2026. This bill was passed by Parliament during the monsoon session. After getting the approval of the President, its provisions are being implemented from October 1, 2026.
Emphasis on making birth-death records more reliable
The new rules aim to make government records related to births and deaths more accurate, transparent and timely. Arrangements for additional scrutiny and monitoring have been made, especially in cases of registration taking place after a long period of time, to ensure the credibility and authenticity of government records.
