Read Desk. The Bombay High Court has banned Bollywood actor Sanjay Dutt's Pune-based luxury nightclub 'Ballr' from playing copyrighted music in public. This action was taken because the club allegedly did not have the necessary approval from 'Phonographic Performance Limited' (PPL) India.
The court has given this interim decision on the petition of PPL India. PPL India had claimed in its petition that their copyrighted music was being used in the nightclub without permission. Located in Pune's Kalyani Nagar area, 'Ballr' is reportedly owned by Sanjay Dutt and Heramb Shelke. According to a report, a representative of PPL had visited 'Ballr' in June.
During this tour, they found many popular songs from PPL's collection being played in the club. These songs included famous tracks like “Badtameez Dil,” “Dard-e-Disco,” “O Saki Saki,” “Dus Bahane” and “Mauja Hi Mauja.” It was also reported that international hits such as Justin Bieber's “What Do You Mean” and Dua Lipa's “Levitating” were also being played.
During the court hearing, it came to light that 'Ballr' had earlier taken a license from PPL to use his music. However, that license had reportedly expired and was not renewed. Subsequently, the Court ordered nightclub owners not to play or share PPL's copyrighted music in public without obtaining a valid non-exclusive public performance license.
PPL India is one of the main organizations in the country that licenses music. They represent music labels and handle the licensing of sound recordings for public performance and commercial use.
Following the court's decision, PPL lawyer Hiten Vasan said the organization would continue to investigate cases where copyrighted content is being used without permission, and would take legal action if necessary. He further said that this interim order of the Court shows the legal problems that businesses may face if they continue to use copyrighted music without proper permission.
Sanjay Dutt has not yet given any official statement regarding the court order or the claims against his nightclub. According to reports, 'Ballr' in Pune is considered to be a great nightlife spot and one of the famous clubs of the city.
