SC reserves decision regarding bail plea of Pawan Kheda in the case of CM Himanta Biswa’s wife.
On Thursday, the Supreme Court reserved its verdict on the petition of Congress leader Pawan Kheda in the passport dispute case of Rinki Bhuyan, wife of Chief Minister Himanta Biswa Sarma, in which he had sought anticipatory bail by the Assam Police. After the Gauhati High Court rejected Kheda’s anticipatory bail plea, Justice J.K. The bench of Justice Maheshwari and Justice Atul Chandurkar heard the case. This case is related to Kheda’s allegations in which he had said that Rinki Bhuyan Sarma has several foreign passports and has financial interests in foreign countries.
The lawyer made an argument regarding the case
Advocate Abhishek Manu Singhvi, appearing for Pawan Kheda, argued that there was no need for custodial interrogation and questioned the need for arrest. He asked, "Why is it necessary to humiliate through custodial interrogation?" And stressed that this case is mainly related to defamation and damage to reputation.
Lawyer Singhvi described the case as unprecedented and said that the fear of arrest has increased further after the public statements made by Assam Chief Minister Himanta Biswa Sarma. He told the court that some of the comments were not even fit for publication and claimed that Sarma had threatened that Kheda would spend the rest of his life in an Assam jail. He made such comments a "constitutional cowboy" And "constitutional rambo" And also said that seeing such conduct of a person holding a constitutional post, Dr. B.R. Even Ambedkar would have been surprised.
Appeal regarding bail
The lawyer further argued that Kheda is a well-known personality and there is no danger of him running away. Along with this he said that he will cooperate in the investigation. He emphasized that most of the allegations made in the FIR are bailable, for which arrest is not necessary. Describing Assam Police in the court, Singhvi said "50-70 soldiers were sent to Kheda’s house as if he was a terrorist."

Opposing the plea, Solicitor General Tushar Mehta, appearing for the state of Assam, told the court that the documents shown by Khera "fake and fake" and no such passports were issued by any authority. He argued that custodial interrogation is necessary to find out who created these documents, who helped Kheda and whether any foreign person was also involved in it.
Was granted bail on 10th April
Earlier, Pawan Kheda had approached the Telangana High Court, where he was granted transit anticipatory bail for 10 weeks. Later, on April 15, the Supreme Court stayed this bail and directed him to seek relief from the concerned court of Assam. Subsequently, the Gauhati High Court rejected his anticipatory bail plea, saying that custodial interrogation was necessary and the case involved more than just defamation.
