SCBA strict on indecency in Supreme Court: Demand for guidelines on court video recording and social media dissemination

New Delhi, July 11. The Supreme Court Bar Association (SCBA) has expressed a strong reaction to an unprecedented incident that took place during judicial proceedings in the Supreme Court on Friday. The association condemned the alleged indecent and insulting behavior of a litigant before the court, saying that such incidents are a serious challenge to the dignity of the judiciary and the sanctity of the justice system.

SCBA said in its official statement that Justice K. The conduct of the party concerned during the hearing before the bench comprising Justice V. Vishwanathan and Justice Alok Aradhe was completely unacceptable. Abuse, threats or any kind of disruption within the court affects the judicial process and is a direct attack on the rule of law. The Bar Association said that the dignity and respect of the court should be maintained in all circumstances. Discipline and decorum within the court are the cornerstone of a democratic justice system, hence strict action should be taken in such cases in accordance with the law.

Demand for guidelines on video recording and social media

After the incident, SCBA has demanded preparation of detailed guidelines regarding video recording, clipping, editing of court proceedings and their dissemination on social media. The association says that at present, videos of court proceedings or their edited excerpts are increasingly circulated on social media. Many times these are presented out of context, leading to misinterpretation of facts and affecting the image of the judiciary. SCBA stressed that a clear mechanism should be put in place so that misuse of courtroom recordings can be prevented and the dignity of judicial institutions protected. According to the association, videos circulated out of context can create confusion among the general public and undermine public confidence in the judiciary.

Appealed to the Central Government also

The Bar Association has requested the Central Government to take necessary administrative and legal steps in accordance with the law to remove such videos and edited clips from social media platforms, which are aimed at insulting the dignity of the judiciary or undermining public confidence in the courts. SCBA concluded by saying that maintaining the sanctity of court proceedings is a shared responsibility of all parties and no compromise can be accepted with respect to the judiciary.
