Lucknow. An important judicial decision has come out regarding the Old Pension Scheme (OPS) in Uttar Pradesh, which has given great relief to the employees who have been waiting for a long time. The Lucknow bench of the Allahabad High Court, while rejecting the special appeals filed by the state government, made it clear that the reasons given for the delay were not sufficient.
what is the whole matter
The case pertains to junior engineers of the Public Works Department (PWD) who were appointed on daily wages or work charge basis between 1984 and 1989. Later a controversy arose regarding their regularization.
Court’s strict stance
The division bench, comprising Arun Bhansali and Jaspreet Singh, observed during the hearing that the government’s appeals were filed much after the stipulated deadline. The delay ranged from 90 days to around 200 days. The government cited movement of files, departmental procedures and other reasons, but the court did not consider these to be justified. The court clearly said that administrative laxity cannot be made the basis for delay.

After this decision, the concerned junior engineers will be considered regular from 2001 instead of 2006. This will have a direct impact on their service conditions and they will come under the ambit of the old pension scheme.
