'We do not want to fall into this trap…' Why did ED back out from CBI investigation on Mamata Banerjee?

An important hearing was held in the Supreme Court on Tuesday in the case of Chief Minister Mamata Banerjee's intervention against the ED raid on I-PAC locations during the elections in West Bengal. During this, Solicitor General Tushar Mehta and Additional Solicitor General SV Raju presented their arguments before the court on behalf of the Enforcement Directorate (ED).

During the hearing, senior lawyer Maneka Guruswamy, appearing on behalf of Mamata Banerjee, raised the question that why do you not recommend a CBI investigation in this entire matter? Guruswami argued that now the government has changed, this can happen easily. The hearing bench of Justice Prashant Kumar Mishra and Justice NV Anjaria also agreed to this suggestion.

However, Solicitor General Tushar Mehta opposed this and said that we do not want this. He requested the Supreme Court to look at this matter from a comprehensive perspective. He said that he does not at all want that after the change of government, he should be accused of starting a CBI investigation against Mamata Banerjee out of political vendetta.

Tushar Mehta's argument – This can become a political issue

According to legal news website 'Bar & Bench', during the hearing, Tushar Mehta said that he did not want to get trapped in the political trap that the investigation was handed over to CBI as soon as the government changed in the state. This could become a political issue, which they want to avoid. He stressed that it would be better if the Supreme Court gives a decision based on the merits of this case.

At the same time, during the hearing, Additional Solicitor General SV Raju argued that the Supreme Court will have to decide whether the CBI can investigate the case if a crime is committed by a sitting Chief Minister.

After hearing the arguments of Tushar Mehta and SV Raju, the court did not immediately issue any order in the matter. The next hearing of the case has now been fixed for September 2. In the next hearing, senior lawyer Kapil Sibal and senior lawyer Shyam Diwan will participate in the advocacy on behalf of Mamata Banerjee.

Demand to register FIR against Mamata Banerjee

It is noteworthy that the Enforcement Directorate has filed a writ petition in the Supreme Court demanding registration of an FIR against Mamata Banerjee and some senior officers of Bengal Police and a CBI investigation into the entire matter. This petition has been filed regarding the alleged interference of Mamata Banerjee during the ED raid on I-PAC.

It has been alleged in the petition that Mamata Banerjee, when she was the Chief Minister of West Bengal, had obstructed the ED's action. It was on his instructions that the local police officers stopped the ED team from fulfilling their legal responsibilities.

This entire controversy took place on January 8, 2026, when the ED raided the premises of I-PAC and its founders. During this raid, Mamata Banerjee first reached the residence of I-Peck co-founder Prateek Jain and then went to the office in Salt Lake.

Mamta Banerjee alleged that at the behest of BJP, ED officials had come to seize secret documents related to the elections. During that time, Mamata Banerjee was seen leaving Prateek Jain's house with some files.
