Delhi High Court has given a big decision regarding the derogatory and objectionable comments made on social media against the judiciary. The court made it clear in its decision that tampering with the dignity of the judiciary in the name of freedom of expression will not be tolerated at all. Gulshan Pahuja had made controversial remarks calling the judiciary a ‘dictatorship’.
Gulshan Pahuja runs a channel named Fight 4 Judicial Reforms on YouTube, through which he used to share videos related to courts and judicial system. High Court enraged over the comment
During the hearing, the controversy in the courtroom escalated when Gulshan Pahuja, instead of expressing regret for his actions, continued to justify his statements. He said before the court that he had no hope left in the Indian justice system. He argued that the ‘arbitrariness’ of the courts is continuously increasing and the other name of this arbitrariness is ‘dictatorship’. The court noted that there was no remorse in Pahuja’s conduct, but he presented more controversial arguments to the court.
Court: No remorse shown
The division bench made it clear in its order that such indecent comments directly weaken the image, authority and public trust of the judiciary. The court said that if any kind of leniency or leniency is shown in such cases, it will send a wrong message to the society and will encourage such tendencies in future. The court has also imposed six months’ jail on Pahuja along with a financial fine of Rs 2,000.

However, Delhi High Court did not accept his argument. The court said that his real intention was to weaken the dignity and authority of the judiciary. However, giving them some relief, the court has put a stay on the punishment for 60 days, so that they can challenge this decision in the Supreme Court.
