Explainer: Debate broke out on AI photo-video of Yami Gautam-Jhanvi Kapoor, know what action can be taken if the photos of stars are tampered with.

Yami Gautam-Janhvi Kapoor Ai Photo Debate: Today the use of AI has increased a lot. It is increasingly being used to create photos, videos and many other types of digital content. Although this made the work easier, but the misuse has also created problems for the celebrities. This concern has been brought to the fore in the recent cases related to Yami Gautam and Jhanvi Kapoor. Recently, the pictures and videos of both the actresses were tampered without their consent. The biggest concern about AI is that someone's real image can be changed to create content that looks real and the image of celebrities can be harmed.

Jhanvi Kapoor's video was tampered with

The major reason for this controversy was when an objectionable deepfake video of Jhanvi Kapoor made with AI has surfaced. Actually, the song 'Chuttamalle' from Jhanvi and Junior NTR's film 'Devra Part One' became quite popular when it was released. The original video of this song was converted into deepfake with the help of AI. According to the information, Jhanvi's face and body parts were morphed in the video, due to which the content appeared completely different and obscene. After this, many people from the film industry along with Jhanvi's fans expressed their displeasure. Junior NTR, Chiranjeevi and Vijay Deverakonda also demanded strict action against the accused against such content.

What did Yami Gautam say about her AI photos?

Amidst the discussion of Jhanvi's video, Yami Gautam also reacted and expressed concern over the misuse of AI. He appealed to media houses, paparazzi and fans on social media that his photos taken during public events, award shows or film promotions should not be altered with beauty filters rather than AI. Yami said that it is not right to change the image of a person without his permission. Media should show photographs in natural and original form.

What is deepfake?

Deepfake is content created using AI and deep learning technology in which a person's face, voice or other features are fitted into another video or picture. After this, that face can be placed in some other content in such a way that it looks absolutely real. This is the reason why it is sometimes difficult for a common user to differentiate between real and fake videos. Similarly, some wrong people prepare photos and videos of celebrities with objectionable content using AI.

How much damage is done to a celebrity's image?

Actually, the identity of every actor and actress is a special part of their professional life. Their years of hard work can be ruined by AI in no time with one fake video. Not only this, such fake content poses a big threat to the image and can also increase pressure on personal life. However, there is another aspect of Yami's concern. If someone's photo is made to look more beautiful or different without their consent, their true identity is altered, making it difficult to distinguish between real images and deepfake content.

What is the law on tampering with photos or videos?

According to the information, Information Technology Act can be taken in many cases related to digital content in India. If a person's privacy is invaded by morphing or editing his photo without consent, then he can file a case under Section 66E of the IT Act. If proven guilty in this case, jail and fine may also be imposed. Although there is a different law regarding each case as to which section the action will be taken, it depends on the nature of the content and the entire case.

There is more strictness on obscene deepfakes

If the content generated by AI is highly objectionable and obscene and is shared online, then the matter can become even more serious. According to the information received, Section 67 and 67A of the IT Act can also be imposed in such cases. These sections prohibit publishing or transmitting obscene or banned content online. If a crime is proved for the first time in this case, then both jail and fine can be imposed. Whereas in the same case, if the offense is repeated, the punishment and fine may increase. Therefore, it is not right to share a fake video only on social media.

Action can also be taken under Indian Judicial Code

Apart from the IT Act, action can also be taken under the Indian Justice Code i.e. BNS considering the seriousness. If an attempt is made to deliberately tarnish someone's image through a fake video or photo, a case can be filed against defamation and other crimes. Apart from this, action can also be taken on things like misuse of identification or hurting the dignity of a woman. Police can investigate in such cases. Some time ago, Delhi Police had investigated the case of deepfake video of actress Rashmika Mandanna and an arrest was made in the case.

What are personality rights?

Let us tell you that celebrities have personality rights related to their identity. If we understand this in simple language, it means that not everyone can use the name, face, voice or identity related things of a star as per their wish. Especially when wrong content is created from it. Courts can hear such cases regarding the protection of the identity and image of the celebrity and have also given orders in this matter. Let us tell you that in a case related to Samantha Ruth Prabhu, the Bombay High Court had given instructions to remove fake content related to her name and face.
