J&K HC’s big decision: Relief to Mehraj Malik, PSA canceled

Srinagar: Jammu and Kashmir and Ladakh High Court has given a major verdict in the detention case of AAP MLA Mehraj Malik, canceling his detention under the Public Safety Act (PSA). The MLA was kept in preventive custody from September 2025. The court gave this order after hearing the habeas corpus petition, paving the way for his release, provided he is not required in any other case.

Jammu and Kashmir and Ladakh High Court has canceled the custody granted to Aam Aadmi Party MLA Mehraj Malik under the Public Safety Act (PSA). With this decision, the MLA who has been in jail for a long time has got a big legal relief. This case was under judicial review for the last several months and hearings were going on continuously.

After hearing the habeas corpus petition, the court gave its decision to cancel the detention order. Advocate Appu Singh, appearing for the MLA, said that a detailed order is awaited, but the court’s decision has been announced in an open hearing. After the verdict, the process of his release is likely to move forward.

Reason for detention and legal process

Mehraj Malik, who is the MLA from Doda assembly constituency and also the Jammu and Kashmir unit chief of AAP, was detained on 8 September 2025. He was accused of indulging in “activities prejudicial to public order”, after which he was sent to Kathua district jail.

In this case, the petition was heard on several dates and on February 23, the court had reserved the decision. After a long legal process, the High Court has now brought an important turning point in the case by canceling the detention order.

Political reactions and future situation

After the court’s decision, this decision has been welcomed by the Aam Aadmi Party. Rajya Sabha MP Sanjay Singh called it a victory of justice and said that prolonged detention was unfair. Responding on social media, he termed it a political injustice.

Former Deputy Chief Minister Manish Sisodia also justified the decision, calling it “Satyamev Jayate”. He said that this decision raises questions on politically motivated actions. Now after the cancellation of the detention order, Malik is expected to be released after the completion of the legal formalities.
