The Congress has demanded the immediate and unconditional release of all detained students, complete withdrawal of all ‘fabricated and vindictive’ FIRs lodged between July 20 and July 22, 2026, a thorough investigation of the police officers involved in the unauthorized phone searches and home detention and their immediate suspension, and strict instructions to stop pressurizing or intimidating students and their families. MPCC president Harshvardhan Sapkal, along with former minister Naseem Khan, party MLA Bhai Jagtap and party official Dhananjay Shinde, expressed serious concern over the detention of hundreds of youth aged between 16 to 30 years.
According to the memorandum, the students were peacefully raising their voice against the problems and chaos present in the national education system when the police took strict action against them.
It is alleged that the police detained 500 to 700 students from various places in Mumbai, including metro stations, public roads and even students’ homes, while many of them could not even reach the protest site.
The Congress chief said that there was no curfew or prohibitory order under Section 144 in force in Mumbai on July 22, 2026. Despite this, the police acted only on suspicion and filed false FIRs against the students in several police stations, including Shivaji Park, Dharavi and Chembur.
The state Congress party alleged in the memorandum that police officials forcefully searched the personal mobile phones of students without any court order or legal authority.
According to reports, students were forced to share their ‘live location’ through mobile devices, which is a violation of their fundamental constitutional rights. The party claimed that 200 to 300 students were still in custody in several police stations including Dharavi, Mahim, Juhu, Chembur and Dadar.
Sapkal said that rule of law prevails in Maharashtra and such arbitrariness of the police will not be tolerated. If the administration does not intervene immediately, the Congress party will stand firmly with the students and start a massive agitation in the entire state.
The memorandum emphasized that peaceful protest is a fundamental right guaranteed by the Constitution. It also warned that treating youth as criminals could jeopardize their future education, job prospects, and opportunities to travel abroad—especially since many of those charged include minors and girls.
