The court has rejected Rahul Gandhi's plea seeking quashing of the criminal defamation complaint filed against Prime Minister Narendra Modi for allegedly using words like 'commander-in-thief' and 'lord of thieves'.
Rahul Gandhi had challenged the summons issued by the Magistrate Court in the Bombay High Court. His argument was that the complaint was not maintainable because he had not taken the name of any person during the speech. He also argued that he had not mentioned any identified person or any particular class. However, the High Court did not accept this argument. The court said that Bharatiya Janata Party is a national level party. Rahul Gandhi had allegedly made controversial remarks targeting Prime Minister Narendra Modi during a rally held in Rajasthan in 2018.
BJP worker had lodged a complaint
BJP worker Mahesh Srishrimal had filed a criminal defamation complaint regarding Rahul Gandhi's speech. The complaint alleged that Rahul Gandhi's comments affected the image of not only Prime Minister Narendra Modi but also the entire BJP and its workers.
After the latest decision of the Bombay High Court, the ongoing criminal defamation proceedings against Rahul Gandhi in the lower court will continue. That is, at present he has not got relief from the High Court in this matter. Another defamation case in Maharashtra Another criminal defamation case is also going on in Maharashtra against Rahul Gandhi. This case was registered in Bhiwandi of Thane district on the complaint of RSS worker Rajesh Kunte.
According to the complainant, during the 2014 election speech, Rahul Gandhi had accused RSS of having a hand in the assassination of Mahatma Gandhi. It has been claimed that this statement will damage the image of RSS. The judicial process of this case is going on in Bhiwandi court.
