The lower court had considered the rarest of rare case
Let us tell you that Saurabh Rajput's life was brutally taken away in Brahmapuri police station area of Meerut. After committing the crime, to hide the body, it was put in a blue colored plastic drum, filled with a solution of cement and concrete and sealed. When this terrible murder came to light, there was a sensation in the entire area. The police showed promptness and arrested Sahil Shukla and Muskaan Rastogi after investigation. After this, the session trial of this case was conducted in the District and Sessions Court of Meerut. On the basis of available evidence, the court convicted both of them for murder and destruction of evidence. Calling it the rarest of rare case, the court sentenced both the culprits to death and also imposed a financial penalty of Rs 50,000.
Joint challenge of 168 pages given in the High Court
Both the convicts have challenged this strict decision of the Meerut court in the High Court, calling it illegal and one-sided. A detailed appeal of a total of 168 pages has been presented in the Allahabad High Court on behalf of the culprits. In this legal battle, senior advocate Sushil Shukla along with advocates Nidhi Trivedi, Ravitendra Pratap Singh Chandel and Sandeep Kumar Dubey will represent the culprits. In the appeal, the court has been urged to reject the trial court's death sentence and conviction order. Along with this, a request has been made to completely acquit both of them from all the charges of murder and destruction of evidence under the Indian Justice Code.
Important legal questions raised in the appeal
In this petition filed in the High Court, serious questions have been raised on the entire legal process of the lower court and the action of the investigating agencies. The defense argues that the entire case was based solely on circumstances and the prosecution failed to prove its story without any concrete eyewitnesses. It has been said in the appeal that the trial court, ignoring the established legal rules, gave such a huge decision only on the basis of speculations and conjectures. Apart from this, there is a huge difference in the statements of the witnesses presented regarding the purchase of weapons, cement and drums used in the incident. According to the petition, no concrete receipt or concrete CCTV footage related to the purchase could be presented before the court by the investigation team.
The culprits in the snake case are also preparing to go to the High Court.
