Shock to husband Samarth Singh in Twisha Sharma case, default bail petition rejected

The court has rejected the default bail plea of ​​Samarth Singh, the main accused in Bhopal's Twisha Sharma death case and husband of the deceased. The court said that the CBI had filed the charge sheet within the stipulated time and the charge sheet cannot be considered incomplete pending further investigation.

The special court headed by ACJM Shobhana Bhalve rejected his default bail plea. The defense had argued that the investigation was not completed within the stipulated time and the charge sheet was incomplete, hence the accused should get the benefit of default bail.

The CBI, which is investigating this case, had filed a charge sheet in the court on August 17, the 87th day of Samarth Singh's detention. The court had taken cognizance of the charge sheet on August 25. After this, the defense demanded default bail, calling the charge sheet incomplete.

Rejecting the defense argument, the court said that the CBI had filed the charge sheet within the stipulated period of 90 days. According to the court, a charge sheet filed in time cannot be considered incomplete merely on the ground that further investigation is pending. The lawyers appearing for the victim's family and the CBI also opposed the default bail. He said that the main investigation has been completed and the charge sheet has been filed within the stipulated period. Accepting these arguments, the court also cited the Supreme Court's decision in the CBI vs. Kapil Wadhawan case.

Samarth Singh has not got any relief at present after the default bail petition was rejected. Now further action will be taken regarding framing of charges in the case and the trial process will proceed.
