New Delhi. The Supreme Court (SC) on Tuesday gave a major decision in cases related to student movements. SC has ordered to stop further action on 129 FIRs registered in five states including Delhi. These cases were registered during the student protests. While hearing the appeal of the Central Government, the court used the special power given under Article 142 of the Constitution.
FIRs were registered in five states including Delhi
Apart from Delhi, FIRs were also registered in Bihar, Maharashtra, Assam and West Bengal during the student movements. The Supreme Court has approved the process of withdrawing a total of 129 cases registered in all these states.
On Tuesday, i.e. on September 1, Solicitor General Tushar Mehta, who appeared in the Supreme Court on behalf of the Central Government, demanded closure of these cases. He told the court that while ending the agitation, the government had given assurance of withdrawing the cases registered against the students.
After the Centre, the states also informed about withdrawal of the case.
A list of cases related to Delhi was presented by the Central Government in the Supreme Court. After this, petitions were also filed by Bihar, Maharashtra, Assam and West Bengal to withdraw the related cases.
The states told the court that they were withdrawing the relevant cases related to the student protests in their respective states.
Supreme Court gave order under Article 142
During the hearing of the case, the bench headed by Chief Justice Surya Kant made it clear that no further action will be taken on these FIRs. The court said that the related cases are now part of history.
The Supreme Court, using the special powers granted under Article 142 of the Constitution, ordered the quashing of the FIR. Under Article 142 the court can issue special orders necessary to ensure complete justice.
Court also keeps an eye on cases of other states
The Supreme Court also said that if cases related to student protests are registered in any other state, their investigation should not be proceeded with.
After this decision, the path of legal action has been closed on 129 FIRs registered against students in Delhi, Bihar, Maharashtra, Assam and West Bengal. This order of the Supreme Court to end the old cases related to students is being seen as a big relief.
