Petition demanding NIA investigation in Jantar Mantar protest case rejected, Delhi HC said – decision is the right of central government

The Delhi High Court has rejected a PIL demanding a National Investigation Agency (NIA) investigation into the protests that took place on July 20 during the march from Jantar Mantar to Parliament House. However, the court gave liberty to the petitioner to withdraw the petition.

A bench of Chief Justice Devendra Kumar Upadhyay and Justice Tejas Karia made it clear that the decision to hand over the investigation of a case to the NIA falls within the jurisdiction of the central government and not the court.

What did the court say on NIA investigation?

During the hearing, the advocate appearing on behalf of the petitioner organization and the lawyers appearing on behalf of the Central Government requested for issuing notice in the case. In the petition, there was a demand to get the incident of July 20 investigated by NIA or any special investigating agency.

However, when the bench started writing the order, Solicitor General (SG) Tushar Mehta, appearing for the Central government, requested that certain parts of the proceedings not be recorded. He also urged the petitioner to withdraw the petition.

Court said- FIR has already been registered in the case

The bench said that NIA is not a normal investigating agency and an FIR has already been registered in connection with the incident. The court said that if after the completion of the investigation the Central Government feels that the case should be handed over to the NIA, then the government can take a decision in this regard.

Allegations of a big conspiracy were made in the petition

This PIL was filed by Satish Kumar Aggarwal, former vice president of All India Hindu Mahasabha. The petition claimed that the July 20 protests were part of a larger conspiracy and foreign-funded organizations and political figures may have an alleged role in it.

The petition alleged that the protest was not limited to issues related to students or student interests, but there could be an alleged conspiracy behind it to use foreign forces and economic resources with the aim of destabilizing the country.
